Danish Banks Attack Impairment Rules Amid Credit Crisis

March 8 (Bloomberg) -- Danish banks are lashing out at the country's financial regulator for imposing stricter impairment requirements that the industry warns will choke lending and hamper an economic recovery.

The rules will inflate the financial industry's loan losses and prompt banks to retrench to protect capital buffers, said Poul Kjaer, head of regulation at the Danish Bankers Association in Copenhagen. The Financial Supervisory Authority argues tighter rules are needed to restore confidence in the industry.

"Banks won't be able to loan as much," Kjaer said in an interview. "That is something the government and members of parliament have to be aware of and look very closely at."

Denmark last week presented its fifth bank rescue bill since 2008 as lawmakers struggle to end a crisis that claimed three lenders last year and forced losses on senior creditors. The bank regulator has tightened standards in an effort to restore credibility to an industry burnt by a property bubble that burst in 2007. Banks and business groups say regulatory measures now risk exacerbating the crisis rather than ending it.

The Danish Bankers Association has taken its case to Business Minister Ole Sohn in an effort to prevent the FSA from implementing its proposal.

The FSA says more stringent rules will help prevent a repeat of the accounting abuses that spurred Denmark's regional banking crisis. The proposal requires lenders to write down the value of their property portfolios to match market declines, the FSA said Feb. 6.

Housing Collapse

Danish house prices slumped an annual 8.7 percent in December, the statistics office said on Feb. 29. Property values will have lost 25 percent by 2013 since the crisis started in 2007, the government-backed Economic Council said in November.

Still, writing down loan portfolios to match sliding market values will deplete balance sheets just as businesses are crying out for loans to fund investment needed for growth, Kjaer said.

"They say we have to stimulate the economy on the one hand and then say something else on the other hand," Kjaer said. "We have talked with banks, and they say that impairments will increase and when impairments increase, that means they won't have as much liquidity -- they can't make loans to companies, farmers, private people."

Job Cuts

In a December survey, two thirds of the Confederation of Industry's 10,000 members said they had limited access to financing, and one in five said an absence of funds is the main obstacle to growth. The situation has deteriorated since then, the confederation's head Karsten Dybvad said in February.

A total of 29 Danish companies last month announced 1,433 job cuts, according to Danske Bank A/S data. Adjusting for seasonal swings, the number reached about 1,770 in February compared with 1,100 in January, according to Danske analyst Jens Naervig Pedersen.

"This is evidence that there continue to be a lot of companies that are struggling to make ends meet," Pedersen said in a note to clients today.

The government said last week it will create an agency to handle bad farm loans and also set up a unit under Denmark's bank resolution agency to take over some property loans. The measures are designed to free up bank capital and encourage the industry to provide more credit to businesses.

The FSA is seeking responses from the industry before it adopts the new rules. The financial regulator won parliamentary approval last year to clamp down on writedown practices after a series of audits found lenders took what FSA Director General Ulrik Noedgaard has called an "optimistic approach."

Bank Failures

International Financial Reporting Standards gave banks too much leeway, leading small and medium-sized lenders in particular to understate loan losses and paving the way for the collapse of Amagerbanken A/S and Fjordbank Mors A/S, Noedgaard said in August. Those failures closed funding markets to most of Denmark's 120 banks and triggered a swath of ratings downgrades by Moody's Investors Service.

"We are now processing the comments from the industry and other stakeholders, so right now the FSA won't comment," said Soeren Christensen, a spokesman for the regulator.

Noedgaard said in January he wants lenders to get their "risks on the table" to get rid of "zombie banks."

Iceland Seeks Political Retribution Law as Haarde Tried

March 8 (Bloomberg) -- Iceland is using a criminal trial examining former Prime Minister Geir H. Haarde's role in the island's 2008 banking crisis as a platform to seek laws that will make it easier to prosecute politicians.

"There's a need to review the whole legal framework," Justice Minister Ogmundur Jonasson said yesterday in an interview in Reykjavik. "People must review the laws on ministerial responsibility in light of the experience and the discussions that have taken place in this particular case."

Haarde stepped down in 2009 amid street protests blaming his government for the island's financial meltdown. He is the world's first political leader since the global credit crisis started to face criminal prosecution for his economic policies. Jonasson, who has blogged his opposition to the case against Haarde, says any changes to the law wouldn't affect the former prime minister's trial.

"I originally supported that Haarde be indicted but changed my position," Jonasson said. His change of heart followed parliament's decision to drop charges against other Cabinet members, he said.

While several former executives at the failed banks are being investigated, with some receiving jail terms, Haarde is the only politician to face trial. His successor, Prime Minister Johanna Sigurdardottir, has questioned the premise of the case. If found guilty, Haarde faces as long as two years in prison.

'Grave' Danger

Haarde's trial, which is the first of its kind to be conducted at the Landsdomur since the court's creation in 1905, continued this week after lawmakers voted not to interrupt the proceedings. The case against him follows parliament's 2010 indictment, which argued the former premier failed to protect Iceland from "grave" financial danger. Haarde is also being tried for failing to prevent the island's three biggest banks from generating debt 10 times the size of the economy.

Kaupthing Bank hf, Glitnir Bank hf and Landsbanki Islands hf failed at the end of 2008, defaulting on $85 billion in debts and plunging Iceland into a recession that lasted through the first half of 2010 and sent unemployment surging nine-fold. The broad nature of the charges against Haarde has raised questions as to whether they can withstand the rigors of a legal trial.

The case against Haarde "is problematic," Sigurdur Lindal, a law professor at the University of Iceland who has also sat as a judge at the country's Supreme Court, said in an interview. "Not only because of it being questionable whether there was anything that he could indeed have done to prevent a collapse, but also because the penal codes in the law on ministerial responsibility aren't extremely clear."

Haarde Aquitted?

Iceland's special prosecutor investigating the role of policy makers in the crisis, Bjorn L. Bergsson, decided not to press charges against former central bank Governor David Oddsson or the former head of the Financial Supervisory Authority, Jonas Fr. Jonsson. Parliament also voted against including former Finance Minister Arni M. Mathiesen and two other ministers in the trial. A parliamentary committee had originally recommended all five be indicted.

"The indictment is phrased in a very general way, making it impossible to hold a single person liable for what took place in Iceland," Lindal said. "It's my opinion that Haarde will be acquitted."

Singapore Watchdog's Help Sought by Others in Libor Probe

March 9 (Bloomberg) -- The Monetary Authority of Singapore said regulators elsewhere sought its help with probes into the possible manipulation of global interest rates.

"MAS is aware of investigations into possible manipulation of interbank rates by other regulators and has received requests for assistance from some," the Singapore central bank said yesterday in an e-mailed response to questions from Bloomberg News. It didn't identify the regulators involved.

Regulators worldwide are investigating whether banks attempted to manipulate rates including the London interbank offered rate, the basis for $360 trillion of securities worldwide. The probes have called into question whether the banks can be trusted to set the rates with minimal regulatory oversight.

"MAS will also work with the relevant authorities to act on any suspected manipulation" by Singapore-based financial institutions or individuals, the regulator said. "MAS will assist where it is appropriate to do so."

The U.S. is conducting a criminal investigation into suspected manipulation of benchmark rates including Libor, the Justice Department said in a letter to a federal judge that was made public on March 6. The Feb. 27 letter is the first public acknowledgment by the department of the criminal probe. European watchdogs are also scrutinizing potential collusion between firms involved in trading derivatives based on the rate.

Singapore Case

HSBC Holdings Plc, Barclays Plc and Royal Bank of Scotland Group Plc are among banks that have said they've received requests for information from regulators.

In Singapore, RBS has been accused of using an internal probe into Libor manipulation to find scapegoats after condoning such behavior. Tan Chi Min, a trader fired by the Edinburgh- based lender, made the allegations in court documents last month.

Tan said he and at least seven of his colleagues were regularly consulted on the bank's yen Libor submissions by rate- setters and senior managers, according to the complaint filed with the Singapore High Court.

RBS said it fired Tan because he tried to improperly influence the bank's rate setters from 2007 to 2011 to persuade them to offer Libor submissions that would benefit his trading positions, according to the bank's court papers in January.

Japan's Interbank Rate

The Japanese Bankers Association said Feb. 16 it may take measures to improve the way it compiles the nation's key interbank lending rate, known as the Tibor.

Citigroup Inc. and UBS AG were ordered by Japan's Financial Services Agency in December to suspend some derivative transactions after the regulator found that staff at the firms attempted to influence interbank lending rates.

John Lim, an external spokesman at the Association of Banks in Singapore, declined to comment today.

The association, which compiles the Singapore interbank rate, had said there was "little chance" of banks colluding to manipulate the rate, the Business Times reported on Feb. 17, citing the group's director Ong-Ang Ai Boon. The association has no plans to change the way it computes Sibor, according to the newspaper report.

Libor is generated through a daily survey of firms conducted on behalf of the British Bankers' Association in which banks are asked how much it would cost them to borrow from one another for 15 different time periods, from overnight to one year. A predetermined number of quotes are excluded and those left are averaged and published for individual currencies before noon.

Questions about the accuracy of the benchmark were first raised by the Bank for International Settlements, the central bank for central banks, in a March 2008 report that indicated lenders were "wary of revealing" information that could signal they were struggling to borrow funds.
